General terms and conditions
Article 1. Applicability.
1.1 These General Terms and Conditions of Sale (hereinafter: “terms”) apply to all offers, orders and agreements of Het Honingmagazijn, to the exclusion of any other general terms and conditions.
1.2 By placing an order with Het Honingmagazijn, the customer agrees to these terms and conditions.
1.3 These terms and conditions can only be deviated from in writing. In that case, all other provisions of these terms and conditions remain in force.
1.4 All rights and claims stipulated in these terms and conditions and in any additional agreements for the benefit of Het Honingmagazijn also apply to any intermediaries and other third parties engaged by Het Honingmagazijn.
Article 2. Offers/agreements.
2.1 All offers from Het Honingmagazijn are without obligation. Het Honingmagazijn has the right to change prices, in particular when this is necessary on the basis of (legal) regulations. See also article 3.4.
2.2 An agreement is only concluded when Het Honingmagazijn has accepted the order. Het Honingmagazijn has the right to refuse orders with reasons or to attach special conditions to the delivery. If the order is not accepted, the customer will be notified of this within five (5) working days.
Article 3. Prices and payments.
3.1 The stated prices for the offered articles and services are in euros, including VAT and excluding handling and shipping costs, unless otherwise stated or agreed in writing.
3.2 For orders with a delivery address in the Netherlands, the amount due must be paid in advance by bank transfer. For orders with a delivery address abroad, the amount must be paid exclusively by bank transfer, unless otherwise agreed in writing.
3.3 In the event of late, full payment, Het Honingmagazijn has the right to suspend or terminate the relevant agreement and any related agreements.
3.4 If the prices of the offered articles and services increase in the period between the moment ofordering and the execution of the order by Het Honingmagazijn, the new prices apply.
Article 4. Delivery.
4.1 Any delivery times stated on the website are indicative. The orderer will receive the order with due speed and at the latest within thirty (30) working days, unless otherwise indicated by Het Honingmagazijn. In the latter case, the orderer will receive timely notification of this. Until the moment of delivery, the orderer has the right to terminate the agreement free of charge. Exceeding the delivery period does not entitle to compensation.
4.2 Delivery takes place at the moment that the articles are sent to the delivery address.
Article 5. Retention of title.
5.1 The ownership of delivered articles will only be transferred when the amount due has been paid in full.
Article 6. Intellectual and industrial property rights.
6.1 All intellectual and industrial property rights that apply to the articles delivered by Het Honingmagazijn must be fully and unconditionally respected.
6.2 Het Honingmagazijn does not guarantee that the articles delivered to the customer do not infringe any (unwritten) intellectual and/or industrial property right of third parties.
Article 7. Complaints and liability.
7.1 The customer must check the delivered articles immediately upon receipt. Any defects must be reported to Het Honingmagazijn by email and with reasons within five (5) working days after discovery.
7.2 If it has been demonstrated that an article does not correspond to the agreement, Het Honingmagazijn has the choice to replace the article with a new copy upon return, or to refund the invoice price.
7.3 If the customer does not want an article for whatever reason, he/she has the right to return the article to Het Honingmagazijn within ten (10) working days after delivery and to terminate the agreement. Returns will only be accepted in this case if the packaging of the item and the item itself are undamaged.
If the item in question has already been paid for, the amount will be refunded within ten (10) working days. The direct costs of return shipment will be borne by the customer.
Article 8. Orders/communication.
8.1 Het Honingmagazijn is not liable for misunderstandings, damage, delays or improper receipt of orders and communications as a result of use of the internet, or between Het Honingmagazijn and third parties, unless there is intent or gross negligence on the part of Het Honingmagazijn.
Article 9. Miscellaneous.
9.1 The customer cannot derive any rights from the fact that Het Honingmagazijn may apply these conditions flexibly.
9.2 If one or more of the provisions of these conditions or any other agreement with Het Honingmagazijn are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new, comparable provision to be determined by Het Honingmagazijn.
9.3 Het Honingmagazijn may use third parties in the execution of the order(s).
9.4 Without prejudice to the other rights to which Het Honingmagazijn is entitled, in the event of force majeure Het Honingmagazijn has the right to suspend the execution of the order or to dissolve the agreement without judicial intervention by notifying the customer in writing.
Article 10. Applicable law and competent court
10.1 These conditions and all rights, obligations, offers, orders and agreements to which these conditions apply are exclusively governed by Dutch law.
10.2 All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
